Apricity Mechanical 100 Gallon Fuel Oil Giveaway, Round 2! - Official Rules

1. Eligibility:

This giveaway is open to legal residents of Forest City, PA, and the surrounding 25-mile radius, who are 18 years of age or older at the time of entry. Employees of Apricity Mechanical, their immediate families, and household members are not eligible to participate.

2. How to Enter:

To enter the giveaway, participants must:

1. Like the Apricity Mechanical Facebook page.
2. Comment on the contest post with the phrase: "Top It Off"

3. Giveaway Period:

The giveaway begins on October 1, 2024, and ends on October 31, 2024, at 11:59 PM (EST). All entries must be received by October 31, 2024, at 11:59 PM (EST).

4. Prize:

One (1) winner will receive 100 gallons of recovered fuel oil. The prize is non-transferable and cannot be exchanged for cash or other products.

5. Winner Selection and Notification:

The winner will be selected in a random drawing from all eligible entries received during the giveaway period. The drawing will be conducted on November 1, 2024, at 12:00 PM (noon) (EST). The winner will be notified via a Facebook message or comment reply within 48 hours of the drawing. If the winner does not respond within 72 hours of the notification, Apricity Mechanical reserves the right to select an alternate winner.

6. Prize Conditions:

The recovered fuel oil will be provided as-is, with no guarantees or warranties regarding its condition or suitability for use. The winner assumes all risks associated with the use of the fuel oil. Apricity Mechanical is not liable for any damages or issues that arise from the use of the fuel oil.

7. Publicity:

By participating in the giveaway, participants agree to the use of their name, likeness, and entry for promotional purposes without further compensation, unless prohibited by law.

8. General Conditions:

Apricity Mechanical reserves the right to cancel, suspend, and/or modify the giveaway, or any part of it, if any fraud, technical failures, or any other factor beyond Apricity Mechanical's reasonable control impairs the integrity or proper functioning of the giveaway. Apricity Mechanical reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the giveaway or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.

9. Release and Limitations of Liability:

By participating in this giveaway, participants agree to release and hold harmless Apricity Mechanical, Facebook, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the giveaway; (b) technical errors; (c) printing errors; (d) late or undelivered mail, email, or other communications; (e) errors in the administration of the giveaway or the processing of entries; or (f) injury or damage to persons or property.

10. Disputes:

Except where prohibited, participants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Pennsylvania. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants' rights and obligations, or the rights and obligations of the sponsor in connection with the giveaway, shall be governed by, and construed in accordance with, the laws of the State of Pennsylvania, without giving effect to any choice of law or conflict of law rules.
